These principles of the protection of personal data and the processing of personal data regulate the processing and use of personal and other data of the users of the KME system by the system manufacturer CME Swiss AG (hereinafter referred to as the operator). By using personal and other data, the user confirms his/her consent to the use of the given data to the operator by using the system under the conditions set out in this policy on the protection of personal data.
If the user does not agree with the terms of this privacy policy, he is obliged to stop using the system.
Unconditional acceptance of this Privacy Policy is the beginning of using the KME system.
1. CONDITIONS
1.1. KME system. All exclusive rights to the KME system and its individual elements (including software, design) fully belong to the operator. The transfer of exclusive rights to the user is not subject to this data protection declaration.
1.2. User - a person using the KME system.
1.3. Legislation means the applicable legislation of the European Union.
1.4. Personal data – personal data of the User, which the User separately provides when registering or using the functionality of the KME System.
1.5. Data - additional data about the user (not included in the concept of personal data).
1.6. Registration - filling in the registration forms used by the user in the system by providing the required data.
1.7. Registration Form – a form resident in the System that the User must fill out in order to fully use the System Volume.
1.8. Service (s) - services provided by the operator on the basis of a contract.
2. COLLECTION AND PROCESSING OF PERSONAL DATA
2.1. The operator collects and stores only the personal data necessary for the provision of services to the operator and interaction with the user.
2.2. The user is responsible for the veracity and accuracy of the personal data provided.
2.3. Personal data can be used for the following purposes:
2.3.1. Provision of services to the user;
2.3.2. user identification;
2.3.3. user interaction;
2.3.4. sending informational materials, notes and requests to the user;
2.3.5. Conducting statistical and other studies;
2.4. The operator also processes the following data:
2.4.1. last name, first name and last name;
2.4.2. E-mail address;
2.4.3. Telephone number (including cell phone).
3. METHODS OF PROCESSING PERSONAL AND OTHER DATA
3.1. The operator undertakes to use personal data in accordance with EU law, the General Data Protection Regulation (EU) 2016/679 (GDPR) and the internal documents of the operator.
3.2. The confidentiality of personally identifiable information and other user data is maintained unless such data is publicly available.
3.3. The operator has the right to keep an archived copy of the personal data.
The operator has the right to store personal data and data on servers outside the territory of the user's current country of residence.
3.4. The operator has the right to transfer personal data and user data without the user's consent to:
3.4.1. State authorities, including investigative and investigative authorities, and local authorities at their reasonable request;
3.4.2. in other cases expressly provided for by the legislation in force in the country where the user is located.
3.5. The operator has the right to transfer personal data and data to third parties not listed in point 3.4. of this privacy policy in the following cases:
3.5.1. The user has given consent to such action;
3.5.2. the transmission is necessary as part of the user's use of the system or the provision of services to the user;
3.6. The operator carries out automated processing of personal data and data.
4. PRIVACY
4.1. The operator carries out adequate protection of personal and other data in accordance with the legal regulation (point 3.1 of this document) and takes the necessary and sufficient organizational and technical measures to protect personal data.
4.2. The applied protection measures allow, among other things, the protection of personal data against unauthorized or accidental access, destruction, alteration, blocking, duplication, distribution, as well as against other illegal actions of third parties with them.
5. OTHER PROVISIONS
5.1. This privacy policy and the relationship between the user and the operator that arises in connection with the application of the privacy policy are governed by the law of the current country in which the user is located.
5.2. All possible disputes arising from this agreement will be settled in accordance with the applicable laws at the place of registration of the operator.
Before filing a lawsuit in court, the user must comply with the prescribed preparatory procedure and address the corresponding claim in writing to the operator. The deadline for responding to a complaint is 30 (thirty) business days.
5.3. If, for one reason or another, one or more provisions of the Privacy Policy are found to be invalid or unenforceable, this will not affect the validity or applicability of the remaining provisions of the Privacy Policy.
5.4. The operator has the right to unilaterally change the privacy policy at any time (in whole or in part) without the prior consent of the user.
All changes come into effect when they are published in the KME system.
5.5. User agrees to independently monitor changes to the Privacy Policy by reviewing the current version.
